Article 5

No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment

People living with HIV (PLWH); people living with TB (PLTB); drug users (DU); sex workers (SW); men having sex with men (MSM) and trans*people must not be subjected to torture or to cruel, degrading treatment by the police or representatives of any government authority, or to cruel, degrading punishment by the state. This includes unlawful violence (incl. beating, kicks, arm-twisting, slapping, dragging by the hair) committed by police officers against DU, SW, and insulting, humiliating treatment of PLWH, DU, SW, MSM, trans*people when they seek medical care or other social services.

PLWH, DU, SW, MSM and trans*people must not be subjected to tortures, cruel or degrading treatment by harassers hating the discriminated groups. The responsibility of the state is to ensure their protection.
