Article 10

Everyone ... is entitled in full equality to a fair and public hearing by an independent and impartial tribunal, in the determination of his rights and obligations and of any criminal charge against him.

Criminal cases against people living with HIV; people affected by TB; people who use drugs; sex workers; men who have sex with men and trans*people should be considered in courts in accordance with a general procedure and guarantees, including the guarantee of a proper legal support for the accused person.

Vulnerable groups have a full right to seek for human rights protection in the judiciary system. Such treatment must be considered fairly in order to make a decision based on the law, the objectivity of which couldn’t be influenced by their attitude towards vulnerable groups.
